TDC Tuning Liability Waiver & Release Agreement: This Liability Waiver and Release (“Agreement”) is entered into by the undersigned vehicle owner/customer (“Customer”) in favor of TDC Tuning, its owners, employees, contractors, affiliates, and representatives (“TDC Tuning”).
Acknowledgment of Inherent Risk: Customer acknowledges and understands that engine calibration, ECU modification, dyno operation, and on-road testing (collectively, “Tuning Services”) involve inherent and significant mechanical risks. These activities may expose the vehicle to conditions beyond factory design limits and may result in component degradation or failure. Customer further understands that all tuning services provided by TDC Tuning are intended for off-road use only and may affect emissions compliance.
Release and Hold Harmless Agreement: Customer knowingly and voluntarily releases, waives, and forever discharges TDC Tuning from any and all liability, claims, damages, losses, costs, or causes of action, whether known or unknown, arising from or related to: Mechanical failure or malfunction occurring before, during, or after tuning; Damage to the engine, turbocharger, transmission, drivetrain, clutch, brakes, tires, sensors, electronics, or any other vehicle components; Loss of use of the vehicle, towing expenses, or consequential damages; Emissions-related issues resulting from calibration changes. Customer agrees to hold TDC Tuning harmless from any such claims and agrees that TDC Tuning shall not be responsible for any damages arising from the use, testing, or operation of the vehicle.
Mechanical Condition & Customer Responsibility: Customer affirms that the vehicle is in safe, operable condition and is properly prepared for tuning. Customer is solely responsible for all modifications, parts selection, installation quality, maintenance, and overall mechanical condition of the vehicle. TDC Tuning may perform a brief pre-tune inspection; however, such inspection is not a guarantee, certification, or confirmation that the vehicle is mechanically sound or safe to operate.
Additional Labor, Repairs, and Incomplete Tuning: If the vehicle requires mechanical adjustments, repairs, troubleshooting, or part-related corrections in order to complete or safely continue the tuning process, Customer acknowledges that: Additional labor or diagnostic time may be billed at the discretion of TDC Tuning; Tuning may be halted if the vehicle is found to be unsafe or incompatible; If tuning cannot be completed due to mechanical issues, improper setup, or part incompatibility, a minimum deposite fee is still due, with remaining charges determined at the discretion of TDC Tuning.
No Guarantee or Warranty: Customer understands and agrees that TDC Tuning does not guarantee: Any specific horsepower/torque output, performance outcome, or drivability result; The longevity, reliability, or safety of the engine or supporting components; Compliance with federal, state, or local emissions or inspection requirements. All tuning services are provided “as-is” without any express or implied warranties.
Indemnification: Customer agrees to indemnify and defend TDC Tuning from any claims brought by third parties arising out of Customer’s use, operation, or modification of the vehicle after tuning.
